Terms and Conditions
These General Sales Conditions are agreed between Capbleu and the customers who shop through Capbleu website – https://capbleu.com, designated henceforth by “User”.
The purchases made through this website are regulated only by these General Sales Conditions with exclusion of any conditions previously available on the website or by prior agreement, expressed and in writing.
Capbleu can promptly modify the provisions of its general conditions, whereby the user should reread them, every time you visit the Capbleu site.
The purpose of these General Sales Conditions is to provide and define the information required by the user and regulate all the steps necessary to realize the order.
Order at https://capbleu.com
- To place the order, the user must add items to the shopping cart, edit the quantity of the articles and finalize the purchase through the option “Finalize order”.
- In order to place your order, the user must:
- Register on Capbleu Website
- Do “Log-in”
- Complete the requested information, namely delivery and billing address, shipping method and payment.
- The concretization of the order by the user represent the full acceptance of prices and description of the products available for sale as well as the General Sale Conditions.
- Capbleu respects the deadlines of an order as long as stock are available. In case there is no stock availability, Capbleu will contact the customer by email or by phone, in order to inform the new delivery date of the product. If the customer doesn’t agree with the delivery date, you can choose to purchase another item or refund the amount paid.
Delivery
Orders are delivered through CTT Expresso or another carrier hired by Capbleu. No deliveries will be made in post office boxes.
Capbleu commits to make all the efforts to deliver within 3 to 5 days from the day after of the confirmation of payment of the order, unless otherwise stated in writing.
In case of unavailability of the goods ordered, Capbleu will inform the customer and will proceed to refund the amount that has been paid, within a maximum period of 15 days from the knowledge of unavailability.
Capbleu cannot be held responsible, in any way for any damages, direct or indirect, from delays in delivery or the unavailability of the goods ordered.
Orders are dispatched within 72 hours after confirmation of payment.
Deliveries:
Continental Portugal:
Delivery by CTT Express – 2 working days.
Madeira and Azores:
Delivery by CTT Express within 4 working days.
To follow up an order in progress, the user can send an e-mail to capbleu@capbleu.com or follow the order through the carrier website which will be indicated to the user.
In case you are not available to receive your order, a notice will be left at the delivery address with the indication of the CTT post where the order can be picked up. If it is not withdrawn within the time limit set in the notice, Capbleu considers such an act as a manifestation of will to terminate the contract, being the order canceled and returned to the warehouse. Payment
1. Capbleu allows the User the following payment methods:
a) ATM;
b) Paypal;
c) Credit Card;
d) MBWAY;
2. Capbleu will make all the efforts to ensure maximum confidentiality and security in data transmitted over the internet.
Prices
1. Prices are presented in Euros, taking into account the VAT in force on the date of payment of the order.
Returns & Exchanges
1. Any order agreement made on Capbleu website, can be freely resolved in accordance with Article 6 of Decree-Law no. 143/2001 of 26 April, within a maximum period of 14 days from the date of receipt of the order by the consumer, by communicating its intention to the email capbleu@capbleu.com.
2. In case of resolution, the consumer must keep the goods in such a way as to be able to return them to Capbleu, under proper conditions of use, within 30 days of receiving them.
3. The returns from the USER should be sent by post (CTT) to the address indicated in contacts. The article must always be accompanied by the invoice. Only returns of articles are accepted if they are in the same state in which they were sent
4. Once the right of withdrawal has been exercised under paragraphs 1, 2 and 3 above, Capbleu will refund the consumer of the price paid without any expenses or charges for it.
5. In case of exchange, the USER can make it through the post office (CTT) to the address indicated in contacts. The article must always be accompanied by the invoice. Only exchanges of articles are accepted in the same state in which they were sent.
After-sales services and guarantees:
All the articles sold by Capbleu are covered by the 2-Year Manufacturer Warranty by their respective brands. After the extinction of the warranty, Capbleu also provides technical assistance. In the case of defective products or damage, go to the Capbleu store closer to you, taking with you the article and the respective invoice. Whenever the reparation imply costs for the customer, it will only be initiated after the client accepts the budget.
Personal Data:
The user authorizes Capbleu to treat and use your data in accordance with the Privacy Policy of Capbleu website.
Newsletter Capbleu:
1. The Capbleu Newsletter integrates emails with offers, promotions and informations, sent to the user’s mailbox provided to Capbleu upon registration of the User.
2. In order to modify your personal data, you must go to your personal area.
Intellectual Property:
Capbleu’s website and the content contained therein are protected by copyright and industrial property laws and they can’t be copied, reproduced or disseminated, either in whole or in part. It’s forbidden, in particular, copy or relay any text, logo, graphic, sound or image from Capbleu Website, unless expressly permitted by Capbleu.
The printing and collection of information contained on this site is permitted for personal use.
Litigation and Responsibility:
1. Capbleu is not responsible for any inconvenience or damage caused to the user by the use of Internet network, such as: service interruption, external intrusion, anomalies caused by computer viruses or any other case of force majeure.
2. The law applicable to any contractual relationship established through Capbleu website is the Portuguese law.
3. To settle any and all emerging conflict of any contract entered into under these general sales conditions, Tribunal da Comarca de Guimarães shall have jurisdiction with express waiver of any other.
